论我国居住权制度的构建 —兼议居住权制度视角下“租购同权”困境的解决路径

      居住权作为一项古老的权利类型,滥觞于罗马法。在中国,居住权的兴起到立法承认这一自下而上的过程与罗马法时期居住权的流变有极大的相似性。我国《民法典》物权编(草案)首次将居住权确立为一项独立的、法定的用益物权,意义重大。但其立法设计遵循居住权的人役性,撷取居住权在婚姻家庭中的供养、扶养功能而忽视居住权在促进房屋多元化利用上的潜能。我国居住权制度设计人役性有余,流通性不足,为了实现“住有所居”的目标,有必要补足居住权立法缺漏,赋予居住权相当的流通性,藉此再将居住权引入到租购同权政策,实现从“租购同权”到“居购同权”的转变,以发挥居住权在房屋多元化利用中的特有功能。
英文摘要:
      As an ancient right, habitatio originated from Roman law. In China, the bottom-up process from the rise of habitatio to the recognition of legislation is very similar to the change of habitatio in the period of Roman law. It is of great significance to establish habitatio as an independent and legal usufructuary right for the first time in the real right compilation of the Civil Code (draft) of China. However, its legislative design follows the personal servitude of habitatio, and takes the function of habitatio in fending and supporting marriage and family, but ignores the potential of habitabio in promoting the use of multiple housing. The designer of habitatio in our country has too much servitude, lack of liquidity, in order to achieve the goal of" residents having life", it is necessary to make up habitatio legislative omissions, strengthen its liquidity,so it to lead habitatio to “Tenants Enjoy the Rights as Homeowners”, from "Tenants Enjoy the Rights as Homeowners" to "Residents Enjoy the Rights as Homeowners " , giving play to the unique function of habitatio in the diversified use of houses.
