      从我国目前司法实践中职务发明专利纠纷来看,因职务发明人或设计人无法从单位获得应得的或者合理的奖励和报酬而引起专利纠纷,严重挫伤了发明人从事发明创造的积极性。基于《专利法》保护发明创造、激励创新之宗旨,发明人或设计人获得奖励和报酬的权利应当受到保护。在《专利法》相关司法解释或者条例中增加相关技术贡献率考量因素、保障发明人享有的信息知情权、引进第三方监督机构等要素,对保护发明人权益、解决职务发明奖酬纠纷、促进我国技术成果的产业化有着重要的作用。
英文摘要:
      From the current judicial practice patent disputes in China’s judicial practice, the main reason for the dispute is the service inventor or design. It is extremely unfavorable for a person to be able to obtain a reward or remuneration from the unit or to obtain a reasonable reward and remuneration, thereby causing patent disputes. Based on the patent law to protect the spirit of invention and innovation, the inventor or designer’s right to receive rewards and remuneration should be strictly protected by the patent law. Therefore, in the relevant legal norms such as the patent law, the burden of proof of the unit should be strictly enforced, the corresponding procedural rights of the inventor should be given, and the right to know the information enjoyed by the inventor should be protected. This has a self-evident role in protecting the rights of inventors and coordinating the balance of interests between the two parties and promoting the industrialization of China’s technological achievements.
